Man attacking another dies after shooting by Raleigh resident; no charges filed in Summit Avenue incident: Police

RALEIGH, N.C. (WNCN) — Raleigh police said Wednesday that a man died after a shooting during a dispute late Tuesday morning and that no charges have been filed.

The shooting was reported just before 11 a.m. in the 100 block of Summit Avenue, off S. Saunders Street in south Raleigh, according to a Wednesday morning Raleigh Police Department news release.

Upon arrival on Tuesday morning, officers found a man suffering from a gunshot wound to his upper body, police said. The man, identified Wednesday by police as Emmanuel Graham, 39, was transported to a nearby hospital, where he later died, according to officers.

At the scene, officers found another man who had serious but non-life-threatening injuries from an apparent assault, police said.

“Preliminary details indicate Mr. Graham and the other adult male were in a domestic relationship. Prior to the shooting, they had become involved in an argument that escalated into a physical confrontation,” the Wednesday news release said.

During the dispute, Graham struck the man with a weapon, causing the man to flee to the Summit Avenue area, police said.

Graham then continued to assault the man, police said.

“An uninvolved witness in the Summit Avenue area observed the incident and believed the male was in immediate danger. In response, the individual retrieved a handgun and shot Mr. Graham,” the news release said.

The person who shot Graham stayed at the scene and “complied with officers during the investigation,” police said.

Police said Wednesday that there were no charges in the case.

“After considering the witness statements, video evidence, physical evidence, and the overall circumstances, the District Attorney’s Office decided they will not pursue criminal charges against the resident,” the news release said.
