Settlement reached between ex-NCSHP trooper and family of man killed in Raleigh crash: Records

RALEIGH, N.C. (WNCN) — A settlement has been reached in a wrongful death lawsuit between the family of a man killed in a Raleigh crash and a former North Carolina State Highway Patrol connected to the incident, court records show.

Tyrone Mason, 31, died in a single-vehicle crash on Capital Boulevard in October 2024 after Trooper Garrett Macario attempted to stop him for speeding. Macario disengaged from the chase just before Mason lost control of his vehicle and struck a concrete slab head-on.

In 2025, an investigation determined Macario gave false statements to Raleigh police about the incident at the advice of his superior, Sgt. Matthew Morrison. Body camera footage of the incident shows Macario did not report the chase to the responding Raleigh officers and instead told them he drove up to the crash.

Macario and Morrison were fired from the NCSHP following the investigation, but while their actions were described as “inexcusable”, the Wake County District Attorney’s Office declined to file charges.

After county prosecutors said the troopers would not be criminally charged, Mason’s family filed a wrongful death lawsuit against Macario in United States District Court for the Eastern District of North Carolina, arguing he failed to help Mason following the crash.

On June 24, according to court records, a settlement was announced between Macario and Mason’s family.

The settlement was approved by District Court Judge James C. Dever III on July 29, according to records.

Court records show Mason’s family will be given $200,000 as part of the settlement, more than half of which will be provided to an unidentified juvenile family member.
