DURHAM, N.C. (WNCN) — A Durham mother accused of killing one of her children and attempting to kill another earlier this year will plead not guilty by insanity, court records show.

Andrea Morgan Faust, 41, was charged with first-degree murder and attempted first-degree murder after two of her children, both younger than five, were found unresponsive on Chartwell Court around 5:30 p.m. on Feb. 12. One was later pronounced dead at the hospital, according to Durham police.
Faust was indicted on both charges in Wake County Superior Court on March 2, according to records.

On Tuesday, according to court records, defense attorneys filed a notice stating Faust intends to plead not guilty by reason of insanity and diminished capacity.

Faust was ruled incapable of standing trial on March 25 after she made multiple attempts on her life, including before she was taken into custody and later while she was being held at the Durham County Detention Center. She was taken to Central Regional Hospital to determine if she gained the capacity to go to trial, according to records.
Records show Faust has returned to the Durham County Detention Center, where she remains without bond.
