LUMBERTON, N.C. (WBTW) \u2014 The owner of a North Carolina-based tax preparation business pleaded guilty on Tuesday to conspiring with seven employees to file false returns based on COVID-19 credits to collect nearly $14 million, according to a U.S. Justice Department news release.<\/p>\n

Nejlai Mitchell owned and operated the business with location in Lumberton and Hope Mills. The DOJ said the IRS paid out approximately $13,890,697 in fraudulent refund claims as a result of the conspiracy, <\/p>\n

The seven others employed by Mitchell have already pleaded guilty for their roles in the same scheme, the DOJ said. Mitchell is scheduled to be sentenced in September.<\/p>\n

The fraudulent returns based on paid sick and family leave credit were filed between approximately April 2022 and May 2023, the DOJ said. The credit was passed by Congress to aid struggling businesses during the COVID-19 global pandemic.<\/p>\n

\u201cInstead of honoring their legal and ethical duties as tax preparers, this group allegedly engineered a calculated scheme to enrich themselves by submitting false returns,\u201d Assistant Attorney General Colin M. McDonald of the Justice Department\u2019s National Fraud Enforcement Division said. \u201cStealing taxpayer-funded relief in a national emergency is both reprehensible and deeply harmful to the public, and we will not hesitate to hold accountable those who exploit a crisis for personal gain. The Fraud Division remains unwavering in its commitment to protecting the integrity of federal relief programs and pursuing tax fraud wherever it occurs.\u201d<\/p>\n

According to the DOJ, Mitchell admitted to the conspiracy shortly after Whitnee Leach pleaded guilty on May 19 to participating in the scheme. Both Mitchell and Leach also pleaded guilty to assisting in the preparation of false tax returns.<\/p>\n

The six others pleaded guilty last year to preparing federal tax returns for clients that included materially false items, the DOJ said. Tiffany Moody and Shaneen Ray pleaded guilty on Dec. 9; Eyoubo McBurney and Katrena Stanback pleaded guilty on Sept. 24; and Jeannie Negron and Sylvia Swindell pleaded guilty on Aug. 20.<\/p>\n

Mitchell and Leach face up to five years in prison for conspiracy and three years for preparing and filing false tax returns.\u00a0The remaining six defendants each face up to three years in prison for preparing and filing false tax returns for clients. They are scheduled to be sentenced in July.<\/p>\n
