RALEIGH, N.C. (WNCN) \u2014 A judge on Thursday ordered a Raleigh man not to have or care for any animals after his dog\u2019s three puppies died earlier this month.<\/p>

Ernest L. Yarborough, 27, is facing three felony counts of cruelty to animals.<\/p>\n

He appeared in a Wake County courtroom on Thursday, alongside his attorney. They declined to speak with CBS 17.<\/p>\n

In court, the assistant district attorney said Yarborough said he took his pregnant dog to an emergency veterinarian on June 4, who recommended surgery to save the dog and the puppies.<\/p>\n

However, Yarborough allegedly didn\u2019t pursue the surgery and instead left with the dog, according to the Raleigh Police Department.<\/p>\n

\u201cA vet did a recheck and confirmed there was a puppy that was, they were stuck and that she would need emergency surgery,\u201d the assistant district attorney said in court about Yarborough\u2019s case . \u201cHe still refused the vet care when the, when the adult female dog was taken from vet care, all the puppies were dead at that\u00a0point.\u201d<\/p>\n

The assistant district attorney\u00a0also\u00a0said this was the dog\u2019s second litter, and her first required the same surgery. He added that Yarborough allegedly had the first surgery completed by someone who doesn\u2019t have a license for veterinary\u00a0medicine.<\/p>

Yarborough is also facing\u00a0a misdemeanor cruelty to animals charge. That warrant says he tormented and deprived care from a brown and white bulldog mix. However, it\u2019s unclear if this is the same dog from the felony case involving the puppies.<\/p>

Yarborough\u2019s attorney indicated in court Thursday that he does not currently have the previously pregnant dog in his possession.<\/p>\n

\u201cOn the 14th, we\u2019ve been served with a petition to have, I would call it a \u2018dog bond\u2019 where they pay money to the animal shelter to keep care for the mother,\u201d said Tyler Ellenberg, Yarborough\u2019s attorney. \u201cWe were probably going to be requesting on that day for the dog to be returned to the home. So any modifications or bond changes would be made. We\u2019d ask that it be done on the July 14th Court date when heard on that bond or animal security petition.\u201d <\/p>\n

The judge maintained Yarborough\u2019s secured bond of $30,000 and ordered that he not have or care for any animals during this time.<\/p>
