The vigils were banned in 2020, and the two former organizers were charged in 2021 with inciting subversion under a Beijing-imposed national security law that has virtually stifled the city\u2019s pro-democracy movement. <\/p>\n<p>Chow Hang-tung and Lee Cheuk-yan, two former leaders of the Hong Kong Alliance in Support of Patriotic Democratic Movements of China, have pleaded not guilty. If convicted, they could face up to 10 years in prison.<\/p>\n<p>Observers say their prosecution reflected the city\u2019s decline in Western-style civil liberties, which Beijing promised to maintain for 50 years when the former British colony returned to its rule in 1997. The governments of Beijing and Hong Kong insist that the security law is necessary for the city\u2019s stability.<\/p>\n<h3>Prosecution argues freedom of speech is not absolute <\/h3>\n<p>During the trial, the prosecution focused on \u201cending one-party rule,\u201d one of the alliance\u2019s core demands, arguing that their advocacy was about inciting others to use unlawful means to overthrow the leadership of China\u2019s ruling Communist Party. It alleged the defendants were not advocating for amending the constitution. <\/p>\n<p>On Monday, prosecutor Ned Lai said freedoms of speech, assembly and association are not absolute rights, accusing Lee and Chow of attempting to blur the focus with human rights arguments. <\/p>\n<p>\u201cThe freedoms of speech, association and assembly mentioned by D2 and D4 are not \u2018trump cards\u2019 that can override the law,\u201d Lai said, referring to Lee and Chow by their defendant numbers. <\/p>\n<h3>Defense says no evidence to prove wrongdoing<\/h3>\n<p>Lawyer Erik Shum, who represented Lee, said the prosecution still could not present evidence to prove what exactly the alliance had asked residents to do, even when the trial neared its end. Shum insisted the alliance had not asked people to use any illegal means over the past three decades and had not abused power. <\/p>\n<p>He said it was just dissatisfied with the current situation, asking, \u201cIt can\u2019t even say that?\u201d <\/p>\n<p>He said the court cannot just pay \u201clip service\u201d to protecting human rights and give it an easy pass over the issue of illegal means. <\/p>\n<p>Read more <a href=\"https:\/\/raleighmovingnews.com\/?p=662\">Summer type of heat continues in central NC; rain chances later this week<\/a><\/p>\n<p>The hearing will continue on Tuesday. <\/p>\n<p>In previous hearings, Lee denied that \u201cending one-party rule\u201d means ending the Communist Party\u2019s leadership. He argued that it actually means moving toward democracy, letting the people decide who leads them, and that the Communist Party should not enforce \u201cdictatorship.\u201d <\/p>\n<p>Chow, a barrister who defended herself, had argued that her past writing was not about inciting action or hatred and was instead intended to foster Hong Kongers\u2019 understanding of mainland China, where many Chinese also hoped to pursue democracy. <\/p>\n<p>Their co-defendant, Albert Ho, entered a guilty plea when the trial began in January. Pleading guilty typically could result in a sentence reduction. <\/p>\n<p>The trial, initially scheduled to last 75 days, is expected to end earlier. But the judges have not yet indicated when a verdict could be delivered. <\/p>\n<h3>Chow called the trial \u2018absurd\u2019 <\/h3>\n<p>Amnesty International\u2019s Deputy Regional Director Sarah Brooks said in a statement that the prosecutors\u2019 case relied on \u201cvague, overly broad and arbitrary definitions of \u2018subversion,\u2019\u201d calling on the charges against Chow and Lee to be dropped.<\/p>\n<p>\u201cAlthough this is an absurd trial where the plaintiff has become the defendant, the court proceedings are ultimately a public process where facts can be cross-examined and testimonial evidence can be preserved,\u201d Chow wrote in a post published on her Patreon account last week.<\/p>\n<p>Tens of thousands of people attended Hong Kong\u2019s annual Tiananmen vigils until authorities banned it in 2020, citing the COVID-19 pandemic.<\/p>\n<p>After COVID-19 restrictions were lifted, the former vigil site was occupied instead by a carnival organized by pro-Beijing groups.
