RALEIGH, N.C. (WNCN) — The man accused of threatening President Donald Trump at a car wash in Apex made an appearance in federal court Tuesday in Raleigh.
During that appearance, the defensive team of Daniel Swain, 41, of Summerville, S.C., submitted a motion to determine competency to stand trial.
CBS 17 previously reported that federal investigators said Swain displayed threatening messages on his vehicle traveling on April 29 from South Carolina to Washington, D.C. The criminal complaint from investigators said Swain’s SUV had one message that read “HEADED TO WSH TO KILL THE PRES” located on the driver’s side window.
According to federal investigators, an attendant with the car wash called 911 when he saw the messages, including one that read “TELL DONALD HE IS FIRED.”

According to court records, Swain’s counsel believes he needs a psychiatric and/or psychological evaluation before the trial starts.

“Counsel has reasonable cause to believe that Mr. Swain may be presently suffering from a mental disease or defect rendering him mentally incompetent,” the filing said. “Counsel requests that the evaluation determine whether Mr. Swain understands the nature and consequences of the proceedings against him and whether he can properly assist in his defense.”

The filing said Swain requested that the court place him at the Federal Medical Center in Butner.
Other court records said the Secret Service questioned Swain last year over social media posts that possibly contained death threats against Trump, members of Congress, and Trump’s family.
According to court records, the next scheduled court date for Swain is an arraignment set for July 20 at the federal courthouse in Raleigh.
