Court records show Eatherly was scheduled for a civil debt appearance that morning in Montgomery County.
During Eatherly’s livestream, he claimed the incident began when a man outside the courthouse pointed and laughed at him. Eatherly claims he walked away after interacting with the man, but the man followed him and started punching him. That is when Eatherly said he drew his weapon.

Both Eatherly and another man sustained gunshot wounds and were taken for medical treatment. The other man’s condition is unknown.
After the shooting, Eatherly appeared to keep livestreaming for several minutes. In the video, Eatherly can be heard saying, “Man, I just pray that dude is going to be alright. I tried to walk away from him.”
It remains unclear what led to the incident, but the Associated Press reports that Eatherly is known to film himself saying racially derogatory statements to Black people in public settings.

Eatherly was charged with attempted criminal homicide, employing a firearm during a dangerous felony, aggravated assault causing serious bodily injury and reckless endangerment with a deadly weapon.
The judge explained attempted criminal homicide carries a penalty of between 15 to 60 years in prison. The firearm charge normally carries a sentence between two to four years, but because of enhancement statutes, it would require a mandatory six-year sentence at 100% service if convicted and without prior convictions. Aggravated assault and reckless endangerment charges each carry possible three- to 15-year sentences.
Eatherly has two current pending cases, one in Montgomery County and another in Davidson County. Prosecutors asked for his bond to be addressed at a later hearing so the judge could review all factors and pending cases.
Bond for Eatherly was set at $1.25 million. A preliminary hearing is set for May 26.
The judge cited the seriousness of the charges, public safety concerns, the courthouse location of the shooting and Eatherly already being on bond as factors contributing to the high bond.
